New winter tyre laws for Germany

As from 1. October 2024 in Germany (but not in Austria) the label “M+S” alone is no longer accepted on winter tyres. They must now carry the "three peaked mountain and snowflake" pictogram with or without “M+S”:

The EU's winter tyre symbol

According to the ADAC (the German ÖAMTC) winter tyres with only M+S haven’t been sold since 2018 so nobody should be driving with them anyway.

“Ab 1. Oktober 2024 sind ältere Winter- und Ganzjahresreifen mit bloßer M+S-Kennzeichnung nicht mehr für das Fahren bei winterlichen Bedingungen (Schnee, Eis und Schneematsch) zugelassen. Es werden nur Reifen mit dem "Alpine"-Symbol, einem stilisierten Berggipfel mit Schneeflocke, als wintertauglich anerkannt.
Wer mit einem Reifen ohne Alpine-Symbol im Schnee fährt, muss mit 75 Euro Bußgeld und einem Punkt in Flensburg rechnen. M+S-Winterreifen werden seit Januar 2018 in Deutschland nicht mehr verkauft und sollten nach Empfehlung des ADAC ohnehin ausgetauscht werden: ADAC Tests haben ergeben, dass die Wintereigenschaften nach sechs Jahren merklich nachlassen. Spätestens nach acht Jahren sollten Winterreifen ersetzt werden.”

Of course this is only relevant to those in Austria who may drive through Germany. In Austria tyres only with "M+S" are still legal. However if your tyres don't also show the mountain/snowflake symbol it indicates one of two things: either the tyres date from before 2018 in which case they are dangerously old and should be changed, or the manufacturer has put "M+S" on tyres which are not winter tyres. This is not illegal since "M+S" is not protectable. This explains the move to the copyrighted pictogram.

Punishment

Drivers in Germany caught with the old winter tyres can expect a €75 fine plus a point on the "Flensburg" points system (8 points = driving ban).
