Red-White-Red Cards: Accepting a job outside Austria

Question

If someone with an RWR card takes a job in Germany for example, how long is it before the RWR card gets cancelled and the associated family RWR Plus cards also get cancelled? Is there a grace period between notification and having to leave Austria. I am aware that British Nationals can stay Visa free in Schengen for 90 out of 180 days.

Answer

Quite generally, one is obliged to notify the Austrian Immigration Authority once a requirement for the RWR Card is no longer fulfilled. So, e.g., it would be recommended to send them an email once you know about your last day of work. It is then up to the Immigration Authority to request that one hands in the RWR Card. Often the “period of grace” is around 3 months.

As an aside, if someone is employed in Austria with an RWR residency permit or any other Third Country National permit; they can be posted to Germany temporarily using the Vander Elst rules, however they or their Austrian employer must apply for a Visa at the Germany Embassy first.
